Stern Law Group filed a complaint in the U.S. District Court of the Southern District of Texas, Houston on behalf of multiple former National Football League (NFL) players against the NFL and NFL Properties, LLC. In this case, the former NFL players sought legal representation from the firm for long-term injuries that they suffered while playing in the league. The complaint claims that the NFL and NFL Properties intentionally defrauded, misrepresented and also acted negligently.
Specifically, these former NFL players were all suffering from a common condition known as mild traumatic brain injuries or "MTBI." These types of brain injuries are commonly caused by concussions and related head trauma. This is not the first instance of NFL players suffering from MTBI and its side effects. Stern Law Group claims that for decades there had been evidence that professional football players had been suffering from MTBI. In spite of this evidence, the claim states that the defendants purposefully ignored the risks and even outright denied them.
Scientific research indicates that repetitive stress injuries to the head can lead to neurological damage later on in life. The NFL regulates the game and its players, and therefore took on full responsibility for the players' safety and health. The organization has openly taken responsibility to care for the players. For this reason, Stern Law Group and others claimed that the NFL should be held responsible for these players' injuries and long-term side effects.
How then should the NFL have acted to care for its players in light of the evidence? The complaint claims that the NFL should have been open and transparent about the negative and damaging side effects of multiple MTBI and related injuries. Instead, the complaint claims, they kept this information secret for fear of losing profit. Not only this, but Stern Law Group firmly believs that the NFL went so far as to promote the violence of the game and also praise players who participated despite head injuries.
This complaint was filed in February of 2013. It will be brought before a judge and a jury at trial. The plaintiffs in this case should have been informed by the NFL of the health risks and safety measures that should be taken to treat and prevent the damaging effects of multiple traumatic blows to the head. Should Stern Law Group and other parties representing the plaintiffs succeed, the plaintiffs could recover financial compensation for their long-term chronic injuries, recover financial losses, other expenses and also obtain a declaration of liability on behalf of the NFL and NFL Properties.
