Just this week, Stern Law Group filed a lawsuit on behalf of their client, a victim of a shooting in a Houston apartment complex. Our client is currently undergoing treatment for the injuries sustained in the shooting. Stern Law Group is claiming gross negligence on behalf of the apartment complex and their security company for failing to maintain and ensure safety on the premises.
Parties who own or maintain a property are charged with ensuring that the premises is reasonably safe for visitors, tenants and others permitted to be there. Our firm is claiming that, because the necessary care was not taken, the apartment complex was unsafe and unprotected against the shooting that took place, which consequently injured our client.
This can be seen in § 75.002 of the Texas Civil Practice and Remedies Code, which states that while in many cases an owner/lessee/occupant cannot be held liable for injuries to those who are permitted to be on the premises, this section also "shall not limit the liability of an owner, lessee, or occupant of real property who has been grossly negligent or has acted with malicious intent or in bad faith."
Our personal injury firm is passionate about holding negligent parties accountable for their actions (or inaction, in this case) so that victims can receive the necessary financial compensation for their physical and emotional injuries.
