Types of Medical Malpractice

There are many different cases that are now classified by The Joint Commission as constituting medical malpractice or "never events." Listed below are some of the categories.

Wrong Site Surgery
Wrong site or wrong side surgery takes place when a surgeon operates on the wrong side of the body. For example, a surgeon might operate and remove the healthy kidney while leaving the infected one behind. Surgeons are required to consult with the patient prior to the procedure and then mark which side of the body to operate on. Lack of adherence to proper surgical methods can result in this event.

"Never Events"
This is a term that was coined somewhat recently to describe incidents of medical malpractice that have no excuse for occurring. The National Quality Forum now recognizes 28 events on the list of "never events" which include wrong site surgery, retention of a foreign body post-operation and patient suicide while under the care of a medical facility.

Anesthesia Errors
There can be errors with how anesthesia is administered whether the patient received local, regional or general anesthesia. This is a powerful drug that must be administered carefully. Administer too much and the patient risks serious injury, but administer too little and a patient can wake up during a procedure.

Misdiagnosis / Failure to Diagnose
If a doctor fails to diagnose a medical condition or gives a patient an inaccurate diagnosis due to a failure to stick to proper screening guides, then this constitutes medical negligence.

Medication Errors
A doctor is required to prescribe medications to a patient only after thorough examination and only after adequate patient counseling. A doctor could prescribe a medication that is dangerous to a patient simply because they did not ask the patient about allergies, medical history, etc.

Surgical Errors
Many different errors can take place during surgery, such as leaving behind medical instruments, wrong incisions that result in internal bleeding and the like. While some surgeries are inherently high-risk, other negative surgical events are inexcusable.
